“GET REVVIN’ WITH GETTR” Sweepstakes
NO PURCHASE NECESSARY. A PURCHASE WILL NOT IMPROVE YOUR CHANCES OF WINNING.
Open only to legal residents of one of the (48) contiguous States of the United States or Washington, DC, who are 18 years of age (or age of majority in their jurisdiction of residence, whichever is higher). Void in Alaska, Hawaii and where prohibited by law.
Employees, officers and directors and their immediate family members (parents, children, siblings, spouse) wherever they may live and others living in their same household (whether related or not) of GETTR USA Inc., its parent company, divisions, subsidiaries, affiliates, prize supplier and any entities involved in the development, production, design and implementation of the Sweepstakes are not eligible to enter or win the prize.
By participating, you agree to abide by and be bound by these Official Rules and the decisions of Sponsor and the independent third party conducting the random drawing, which are final and binding in all respects and not subject to appeal.
1.Sweepstakes Period: 9/29/2021 at 12:00:01 a.m. Eastern Time – 10/17/2021 at 11:59:59 p.m. Eastern Time. Sponsor’s computer is the official clock for all purposes of the Sweepstakes.
2. To Enter:
Visit the GETTR Sweepstakes entry page at www.getrevvinsweeps.com. The Sweepstakes entry page is also accessible via hypertext links in advertising materials for the Sweepstakes.
First, complete the Sweepstakes entry form with all required information, including your name, e-mail address, telephone number where you may be reached on 10/18/2021 between 12:00 p.m. (noon) Eastern Time and 6:00 p.m. Eastern Time (if selected as the potential prize winner in the random drawing), and the handle of your account on the GETTR social media platform.**
All entries must be received by 10/17/2021 at 11:59:59 p.m. Eastern Time.
**IF YOU DO NOT HAVE AN ACCOUNT, YOU MUST OPEN AN ACCOUNT IN ORDER TO COMPLETE THE ENTRY PROCEDURE. To open an account, provide a username (subject to availability and other restrictions), password, confirm the password, and provide your birth year. Then, click the NEXT button. (In clicking the NEXT button, you agree to the Terms and Privacy Policy of https://gettr.com.)
3. Entry Restrictions:
Limit of one (1) entry per person. If a given person enters multiple times, only his/her initial entry may be eligible. (If you entered GETTR USA Inc.’s “Get Truckin’ with GETTR” Sweepstakes, you may also enter this Sweepstakes.)
Receipt of entry may be acknowledged by Sponsor; but, any such acknowledgment is not otherwise binding upon Sponsor.
Use of automated, programmed or like means of entry (including third party sweepstakes entry services) is prohibited. Any entry made via such methods is void. Such conduct also constitutes tampering; see Rule 9 below.
Proof of transmission of Sweepstakes entry form does NOT constitute proof of receipt of same by Sponsor or proof of entry.
Participation in the Sweepstakes by using a mobile device may result in the imposition of the wireless Internet access fees and perhaps other charges. Any such charges are the sole responsibility of participant.
Any dispute as to the identity of entrant will be resolved by Sponsor in its sole discretion.
4. Winner Selection:
The prize winner will be selected in a random drawing comprised of all eligible entries received during the Sweepstakes Period. An independent third party, Waddell Serafino Geary Rechner Jenevin, PC will conduct the random drawing on 10/18/2021 prior to 12:00 p.m. (noon) Eastern Time.
The potential prize winner will be notified via telephone. To remain eligible to win, the potential prize winner must accept notification telephone call and commence prize claim procedure. SPONSOR WILL CALL POTENTIAL PRIZE WINNER ONLY ONCE BETWEEN 12:00 PM (NOON) EASTERN TIME AND 6:00 PM EASTERN TIME ON 10/18/2021. IT IS THE POTENTIAL PRIZE WINNER’S SOLE RESPONSIBILITY TO BE AVAILABLE TO ACCEPT WINNER NOTIFICATION TELEPHONE CALL FROM SPONSOR AT SUCH TIME. MESSAGES WILL NOT BE LEFT ON VOICEMAIL OR WITH PERSONS OTHER THAN POTENTIAL PRIZE WINNER. SPONSOR EXPRESSLY DISCLAIMS ANY AND ALL LIABILITY FOR DROPPED, INCOMPLETE, INAUDIBLE, INTERRUPTED OR OTHERWISE DEFECTIVE OR UNSUCCESSFUL WINNER NOTIFICATION TELEPHONE CALLS.
After Sponsor has established contact with potential prize winner, Sponsor will provide to potential prize winner an Affidavit of Eligibility, a Liability Release and a Publicity Release (where legal). To remain eligible to win the prize, potential prize winner must return the completed and signed Affidavit/Release within two (2) days of issuance by Sponsor (or such shorter period of time indicated thereon).†
In the event of noncompliance with the Affidavit/Release requirement (including if Affidavit/Release is not timely received or received at all at provided e-mail address); if potential prize winner cannot be initially contacted by Sponsor via telephone; or if potential prize winner is determined to be ineligible or otherwise in violation of these Official Rules, the prize will be forfeited without compensation of any kind and an alternate potential prize winner selected from among all remaining eligible entries received during the Sweepstakes Period.
In addition, award of the prize is made contingent upon the results of a background check of potential prize winner. In order to remain eligible to win the prize, potential prize winner must provide all necessary consents and requested information in order for Sponsor to conduct the background check. Potential prize winner further understands and agrees that he/she will not receive any prize (nor will Sponsor have any liability to him/her under any legal theory, other than a consolation prize of a $500 gift card provided that the potential prize winner is eligible and otherwise in full compliance with these Official Rules) if Sponsor concludes that the background check is “dirty” and includes any information that may adversely affect the reputation of Sponsor by exposing Sponsor to public disrepute, contempt, scandal or ridicule; such as, winner having committed a felony or any act of moral turpitude. Potential prize winner agrees to be bound by Sponsor’s review and analysis of the background check, which is not subject to appeal.
†Potential prize winner agrees that an electronic signature/affirmation or facsimile version of the Affidavit/Release shall have the same legal force and effect as a hand-signed document. Notwithstanding the foregoing, should Sponsor determine in its sole discretion that the electronically signed/affirmed/facsimile version of the Affidavit/Release is not acceptable, Sponsor may condition award of prize on return of the actual hand-signed document.
5. Prize/Odds of Winning
Prize (1) –2021 Harley-Davidson® Road Glide® Motorcycle‡ and payment of taxes, title and registration fees associated with winner taking possession of Motorcycle (excluding income taxes and other taxes not directly related to Sponsor’s transfer of ownership of Motorcycle to prize winner). Total Approximate Retail Value: $30,000.
‡Third party trademarks are used for purposes of prize identification only. No sponsorship, endorsement, authorization or affiliation of any kind is intended or implied by such use.
Prize winner is solely responsible for any and all costs related to acceptance and use of the Prize. The preceding includes but is not limited to
- upgrades and options not provided with Motorcycle;
- any expenses in operating the Motorcycle (such as, gasoline);
- costs involved in taking possession of Motorcycle.
Motorcycle is awarded subject to availability: Sponsor disclaims any and all liability related to Motorcycle availability due to production delays, limited inventory at participating dealership, receipt of Motorcycle by participating dealership or any other reason. Prize winner may not receive Motorcycle in preferred color; Sponsor reserves the right to include wrapping or other decorative components to Motorcycle, with the understanding that such decorative components will not interfere with Motorcycle being street-ready or its performance. Prize winner must take possession of Motorcycle within thirty (30) days of notification of availability or prize will be forfeited without compensation and an alternate potential prize winner selected as set forth above. To take possession of Motorcycle, a valid motorcycle operator’s license and evidence of insurance may be required. Motorcycle awarded may differ from any motorcycle shown in promotional/advertising materials with Sponsor disclaiming any and all liability in conjunction therewith.
TO THE FULLEST EXTENT PERMITTED BY LAW, THE MOTORCYCLE IS AWARDED “AS IS” AND SPONSOR MAKES NO WARRANTY OF ANY KIND (INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR THE INTENDED PURPOSE) AS TO THE MOTORCYCLE.
Prize winner will be solely responsible for income and other taxes not directly related to Sponsor’s transfer of ownership of Motorcycle to prize winner. Prize winner understands and agrees that, as per applicable law, Sponsor is required to report prize winner’s receipt of the prize (and the fair market value of the prize) to applicable government authorities, including the Internal Revenue Service via IRS 1099 Tax Form; and, to this end, prize winner agrees to fully cooperate with Sponsor including by providing his/her Social Security Number upon request via IRS W9 Tax Form.
No prize substitution except by Sponsor in its sole discretion if advertised prize is unavailable for any reason, and only then for prize of comparable value. Prize is not redeemable or exchangeable for cash. Prize is not transferable without the written consent of Sponsor which may be withheld or granted at its sole discretion and without liability of any kind.
Odds of winning depend on the total number of eligible entries received.
6. Releases.
By participating, entrant indemnifies, releases and agrees to hold harmless GETTR USA Inc., its parent company, divisions, subsidiaries, affiliates, prize suppliers and any entities involved in the development, production, design and implementation of the Sweepstakes and the directors, officers, agents, representatives, shareholders, employees, successors and assigns of any of the above organizations from any and all liability arising from participating in the Sweepstakes, any Sweepstakes-related activity and/or the acceptance, receipt, possession or use/misuse of prize (if applicable).
To the fullest extent permitted by law, acceptance of prize constitutes the winner’s agreement to the use of his/her name, address (city, state), likeness, photograph, other indicia of persona and/or statements made by winner regarding the prize, the Sweepstakes or the Sponsor for advertising/publicity/trade purposes by Sponsor and its designees without further compensation or review, approval or notice of any kind. The preceding may include in Sponsor’s sole discretion the winner participating in a prize award ceremony, media interviews and promotional activities at Sponsor’s request. Nothing herein, however, in any way obligates Sponsor to use winner for advertising/publicity/trade purposes; and, by refraining from doing so, Sponsor shall not incur any liability under any legal theory.
7. Limitations of Liability.
Sponsor assumes no responsibility or liability under any legal theory for any of the following:
any incomplete, incorrect or inaccurate information whether caused by tampering, hacking or by any of the equipment or programming associated with or utilized in the Sweepstakes or by any technical or human error of any kind;
any technological failure, error or malfunction of any kind affecting the operation of the Sweepstakes including the selection of potential prize winner and initially contacting potential prize winner via telephone, including any failure/error/malfunction related to computer hardware, software, network, programming or any other electronic process involved in implementing the Sweepstakes as intended;
late, lost, illegible/garbled, incomplete, damaged, misdirected, corrupted, or jumbled, unrecorded or improperly recorded entries, regardless of cause (all of the foregoing being void.)
8. Force Majeure.
If, for any reason, the Sweepstakes (or any part thereof) is not capable of running as planned by reason of infection by pandemic/epidemic, computer virus, worms, bugs, tampering, unauthorized intervention, fraud, technical failures, fire, flood, storm or other natural cataclysm, act of God, riot, strike, civil commotion, governmental action (whether or not lawful), materials shortage or any other causes beyond the control of Sponsor which, in its sole opinion, corrupt or affect the administration, security, fairness, integrity or proper conduct of the Sweepstakes (or any part thereof), Sponsor reserves the right at its sole discretion to cancel, terminate, modify or suspend the Sweepstakes and conduct the Sweepstakes and select the potential prize winner from among all eligible entries received prior to and/or after (as appropriate) the action taken by Sponsor or otherwise in a manner which is fair, equitable and in accordance with these Official Rules, as determined by Sponsor in its sole discretion.
Notice of such action by Sponsor will be posted at https://gettr.com.
9. Additional Conditions of Participation.
In the event of any inconsistency between these Official Rules and the content of any Sweepstakes promotional/advertising materials, these Official Rules shall prevail, govern and control. Sponsor’s failure to enforce any provision of these Official Rules on a given occasion will not constitute the waiver of such provision.
CAUTION: ANY ATTEMPT TO TAMPER WITH OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES OR TO DEFRAUD SPONSOR OR ITS EMPLOYEES AS TO THE CONDUCT OF THE SWEEPSTAKES CONSTITUTES TAMPERING IN VIOLATION OF THESE OFFICIAL RULES AS WELL AS A VIOLATION OF CIVIL AND/OR CRIMINAL LAW. IN SUCH CASE, SPONSOR MAY SEEK ANY AND ALL AVAILABLE LEGAL REMEDIES AGAINST PERSONS DETERMINED TO BE ENGAGED IN SUCH CONDUCT AS WELL AS DISQUALIFYING THEM FROM THE SWEEPSTAKES AND TERMINATING THEIR ACCOUNT ON THE GETTR SOCIAL MEDIA PLATFORM.
10. Disputes Resolved By Arbitration
To the fullest extent permitted by law, by participating in the Sweepstakes, you understand and agree that any claim or dispute regarding the Sweepstakes or these Official Rules will be resolved individually (NOT AS PART OF A CLASS ACTION/PROCEEDING) by means of binding arbitration (NOT IN A COURT OF LAW, WITH THE RIGHT TO A JURY TRIAL BEING WAIVED.)
As fully set forth in the GETTR Terms of Use (https://gettr.com/terms), such arbitration will be conducted in New York, NY by a one-member panel of JAMS. The arbitrator shall apply the law of New York State to any dispute concerning the Sweepstakes or these Official Rules, without giving effect to choice of law/conflict of law provisions which would result in the application of another jurisdiction’s law.
